Couch Makers and its affiliated brands, including couchmakers.co.za (“Couch Makers Furniture Store”, “Couch Makers”, “we”, “our”, or “us”), provide this website and related online platforms, including applications and services accessible via desktop, tablet, and mobile browsers (collectively, the “Sites”), subject to your compliance with these Terms and Conditions.

These Terms and Conditions form a legally binding agreement between you and Couch Makers. We recommend that you print or save a copy for your records.
By accessing or using the Sites, you confirm that you are legally capable of entering into this agreement and that you agree to be bound by these Terms and Conditions. If you do not agree, or if you are not legally competent to do so, you may not use the Sites.
These Terms include provisions that govern how disputes between you and Couch Makers are resolved. Please review the Legal Disputes section carefully.

Changes to These Terms
Couch Makers reserves the right to modify these Terms and Conditions, the Privacy Policy, or the Sites at any time. Changes will not apply retroactively. Continued use of the Sites after any updates constitutes your acceptance of the revised Terms.
Updated versions supersede all prior versions. We may request that you execute a non-electronic copy of these Terms if required. Any updates will be reflected by a revised “Last Updated” date.

All trademarks, service marks, logos, and branding displayed on the Sites, including the Couch Makers name and design logo (“Couch Makers Marks”), are owned exclusively by Couch Makers. Use of these Marks without prior written consent is strictly prohibited.

You are solely responsible for any User Content you submit. All User Content is considered non-confidential and non-proprietary.

The content complies with all applicable laws and Couch Maker’s Acceptable Use Policy.

Social Media and Public Platforms
Users who post false, defamatory, or malicious content that harms the reputation of Couch Makers or its brands may have their services suspended or terminated.
By using hashtags, mentions, or tags such as #Couch Makersor @Couch Makers, you grant Couch Makers an irrevocable, royalty-free, perpetual, worldwide license to use submitted images or content for marketing and promotional purposes. You warrant that such content does not infringe third-party rights.
Order Acceptance and Availability
An order confirmation or order number does not constitute acceptance of an order. Couch Makers reserves the right to limit quantities, cancel orders, correct errors, or refuse service at its discretion.
Product prices and availability are subject to change without notice. Errors may be corrected even after an order is submitted. Orders that misuse promotions or rewards programs may be cancelled.
Pricing Information
Strikethrough prices reflect previous retail or promotional prices. “Flash Deals” and “Closeout” pricing may be temporary or permanent and may fluctuate. Couch Makers does not offer price matching.
Promotional codes must be applied at checkout and cannot be applied after an order is placed.
Couch Makers Rewards Program
The Couch Makers Rewards Program is available to registered users only. Rewards are subject to these Terms and may be applied to eligible future purchases at participating Sites.
Links to Third-Party Websites
The Sites may contain links to third-party websites not controlled by Couch Makers. We are not responsible for the content, policies, or practices of third-party sites. Accessing them is at your own risk.
Mobile Use and SMS Communications
By accessing the Sites via mobile devices or opting into SMS communications, you agree to receive messages such as promotions, order updates, reminders, and authentication messages. Message frequency may vary. Consent is not a condition of purchase.
Communications with Couch Makers
Any communication you send to Couch Makers is non-confidential. Couch Makers may use, reproduce, disclose, or distribute such communications without restriction for any lawful purpose.
Indemnification
You agree to indemnify and hold harmless Couch Makers and its affiliates from any claims, damages, or expenses arising from your use of the Sites, violation of these Terms, or infringement of any third-party rights.

To the maximum extent permitted by law, Couch Makers shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Sites.
If liability is found, Couch Maker’s total liability shall not exceed the greater of:

Couch Makers may suspend or terminate your access to the Sites at any time, with or without notice, if you violate these Terms or for any other reason. Couch Makers shall not be liable for any termination.
Age Requirement
You must be at least 13 years old to use the Sites. If you are under 13, you may not use the Sites. Parents or guardians who consent to a minor’s use agree to these Terms on their behalf.
Service Availability and Outages
Couch Makers is not responsible for service interruptions, system outages, or data loss caused by maintenance, third parties, or unforeseen technical issues.
Jurisdiction
The Sites are operated from Johannesburg, South Africa, and are intended for users within South Africa. Users accessing the Sites from outside South Africa do so at their own risk and are responsible for compliance with local laws.
General Provisions
These Terms constitute the entire agreement between you and Couch Makers. If any provision is found unenforceable, the remaining provisions remain in effect. These Terms are governed by South African law.
